In April 2021, the Colorado Department of Public Health & Environment (“CDPHE”) published its COLCLC13b Grand Valley Draft Timed Maximum Daily Loads (“TMDL”). This TMDL pertains to Colorado River tributaries in the Grand Valley and concerns discharges of iron, selenium, and E. coli. Reducing the allowed TMDL of selenium, a naturally-occurring mineral commonly leached into waters, will significantly increase regulatory burdens, delays and expenses for public water systems and stormwater permits. While the TMDL is intended to reduce these discharges in order to meet new water quality standards, it was heavily opposed by area stakeholders including MS4 permit holders. After public comment periods and an appeal filed by Mesa County, the CDPHE decided to move forward with the EPA prescribed levels based on questionable data.
Currently Mesa County is working with the CDPHE on the requirements for the COR90000 and the expectations for the TMDL’s. The CDPHE proposed sampling requirements are available by Mesa County at this time. “As we move forward with the CDPHE we will know more about the State’s requirements and the final expectations.
